Enhanced protection against bank card fraud and other cashless payment instruments
The theft of bank cards will be regulated as a distinct criminal offense, while authorities will have more tools to combat fraud involving cashless payment instruments. The Government has approved a draft law proposing amendments to the Criminal Code and the Criminal Procedure Code in order to strengthen the protection of citizens and companies.
In addition to fraud, the draft law also targets actions through which such offenses are prepared or facilitated. Thus, the production, procurement, or provision of devices and computer programs specifically designed or adapted to commit fraud will be punishable when there is an intention to use them for this purpose.
“Technology is developing rapidly, and increasingly sophisticated methods of fraud are emerging. Therefore, it is necessary to align the legal framework so that we can intervene at the preparation stage of fraud,” said Minister of Justice Vladislav Cojuhari.
The draft law also introduces provisions regarding the sale or possession of counterfeit payment instruments or those obtained through criminal activity, with the aim of using them fraudulently.
At the same time, authorities will have additional tools to investigate these offenses, including the ability to verify transactions and obtain financial information in accordance with the law.
