Single legal framework for investigating accidents, incidents in air, rail, maritime transport of Moldova
The national legislation on the investigation of accidents and incidents in air, rail and maritime transport has been modernized and aligned with European practices. The parliament adopted, in the second reading, a draft law providing for these measures.
The adopted document is a framework law regulating the organization, operation and independence of the Bureau for the Investigation of Accidents and Incidents in Transport, as well as the general principles of safety investigations. The specific technical and procedural aspects of air, rail and maritime transport will be regulated separately by the government, in accordance with European Union legislation, after the law enters into force. Until now, the Bureau’s activities has been regulated by another law.
The draft law also provides for a clear separation between technical investigations and administrative and judicial investigations. This approach will help ensure the objectivity of investigations and focus them exclusively on identifying the technical causes and contributing factors behind an accident, without seeking to establish criminal or administrative liability.
The draft also introduces an effective prevention mechanism based on safety recommendations. Formulated following technical investigations, these recommendations will enable operators, authorities and decision-makers to adopt corrective and preventive measures, based on objective data and expert analysis. The aim is to reduce risks and enhance the level of safety in transport.
The Law on the Investigation of Accidents and Incidents in Transport will enter into force six months after its publication in the Official Journal.
