Moldovan parliament adopts amendments to Law on Constitutional Court
Chisinau, September 24, 2026 – The parliament has adopted amendments to the Law No. 74/2025 on the Constitutional Court. The adopted law provides for strengthening transparency rules concerning the procedure for appointing constitutional judges, applicable to parliament, the government and the Superior Council of Magistracy.
According to the new provisions, the competent authority will publish on its website information about the initiation of the procedure and the eligibility criteria. Candidates’ CVs will be published at least 10 days before the decision is adopted, in compliance with personal data protection regulations. On this period, interested sides will be able to submit documented information regarding the candidates’ eligibility. The reasoned decision on the outcome of the appointment will also be published.
If a judge’s term of office expires, the procedure for appointing a successor will be initiated three months in advance, and the new judge will be appointed by the time the incumbent’s term expires.
The amendments concern the stages preceding the appointment. The appointment decision stays within the competence of the authority to which the Constitution grants this prerogative.
According to the legislation, the Constitutional Court is made up of six judges, appointed for a six-year term. Two of them are appointed by the parliament, two by the government and two by the Superior Council of Magistracy. During their term of office, they are irremovable, independent and subject only to the Constitution.
The Draft Law No. 317 of September 1, 2026, was submitted by MP Veronica Rosca.
