Court terminated criminal proceedings in case of former Prosecutor General on violation of privacy of former head of Anticorruption Prosecutor’s Office
The criminal proceedings against former Prosecutor General Alexandr Stoianoglo, in the case in which he was accused of violating the inviolability of the private life of the former chief prosecutor of the Anticorruption Prosecutor’s Office have been terminated. The decision was issued by the Chisinau Court, Buiucani.
By the same ruling, the Chisinau Court dismissed as unfounded the civil action filed by the injured party. The court reasoned that the alleged act does not meet the prejudicial threshold of a criminal offense, and the civil action brought by the injured party was rejected as unfounded.
According to the prosecution, Alexandr Stoianoglo allegedly violated the provisions of Article 177 paragraph (2) of the Criminal Code by knowingly making public information protected by law regarding the private life of the former chief prosecutor of the Anticorruption Prosecutor’s Office, without his consent and by taking advantage of his position as Prosecutor General.
According to the evidence presented in court, Stoianoglo allegedly came into possession of private correspondence of the former head of the Anticorruption Prosecutor’s Office, taken from a mobile phone seized in the context of another criminal case. Prosecutors claimed that on 4 October 2021, during a briefing held at the Prosecutor General’s Office, he publicly read out fragments of the former prosecutor’s private conversations in the presence of media representatives.
Furthermore, according to the indictment, at the direction of Alexandr Stoianoglo, the text of the statements made during the briefing was later published on the official website of the Prosecutor General’s Office.
The decision of the Chisinau Court is not final and may be appealed to the Court of Appeal (Centre) within 15 days.
