New rules to protect health of workers exposed to occupational risks
Government has approved new rules for monitoring the health of workers exposed to occupational risks. The measure aims to prevent work-related illnesses, detect health problems more quickly and ensure safer working conditions in all sectors of economy, with a focus on construction, agriculture and HoReCa.
The new provisions set out when and under what conditions medical examinations will be carried out for workers exposed to occupational risks. These may be performed upon employment, periodically, upon resumption of activity, after exposure has ceased, or in other situations where it is necessary to check the state of health.
An important element is that these costs will not be borne by the workers. The expenses will be covered by the employer and, in certain cases, by the compulsory health insurance funds. If a person pays for the medical examination upon employment and is declared fit for work, the amount must be fully reimbursed by the employer within at most one month from the date of employment.
The examination results will be recorded in the work form, which will indicate whether the person is fit or unfit for the activity they carry out. This mechanism will allow for the application of more appropriate measures to protect workers’ health and the adaptation of working conditions where necessary.
In addition, the new rules provide for electronic record-keeping of data, clearer reporting requirements and a better-defined role for the institutions responsible for supervision and control in this field.
